TERMS OF SERVICE: INBAR AUTOMATION SOLUTIONS

1. THE "INFRASTRUCTURE BUILD" & HANDOVER
1.1. Scope of Work: Inbar Automation Solutions ("The Company") provides a custom digital infrastructure build (the "Build") over a standard 100-day period. This includes "Pillar" mathematical frameworks, Revenue Recovery Engines, and CRM automation logic. 1.2. Handover of Keys: Upon final payment of the build fee ($15,000 USD, unless otherwise agreed), the Company will transfer administrative access (the "Keys") of the specific instance to the User. 1.3. Ownership: The User is granted a perpetual, non-transferable license to use the delivered infrastructure for their internal business operations. All underlying proprietary logic, AI prompt architectures, and mathematical models remain the exclusive Intellectual Property of Inbar Automation Solutions.
2. OPTIONAL MAINTENANCE SUBSCRIPTION
2.1. Term: Following the 100-day build, the User may opt into a recurring Maintenance Subscription to ensure "Infrastructure Health" and ongoing system updates. 2.2. Automatic Renewal: Subscriptions renew automatically on a monthly basis. The User’s card on file will be charged on the same day of each month. 2.3. Cancellation: Users may cancel the subscription at any time by providing 30 days written notice to Inbar Automation Solutions. Upon cancellation, the User retains the "Keys" to their infrastructure but forfeits all rights to technical support, API monitoring, and system updates.
3. PAYMENTS & REFUNDS
3.1. Accepted Methods: We accept Visa, Mastercard, American Express, Discover, and ACH transfers via Stripe. 3.2. No Refunds: Due to the high-intellectual-property nature of the $15,000 Build and the immediate allocation of architectural resources, all sales are final. No refunds will be issued once the project discovery phase has commenced.
4. SMS & TELECOMMUNICATIONS COMPLIANCE (TCPA 2026)
4.1. Message Program: "Inbar Automation Notifications & Alerts." 4.2. Consent: The User warrants that they have obtained "Prior Express Written Consent" for every lead uploaded into the infrastructure. In accordance with the 2026 FCC One-to-One Consent Rule, consent must be specific to the User's brand. 4.3. Opt-Out: All SMS communications will follow the "STOP to Opt-Out" protocol. The User is responsible for ensuring their team does not manually override these system blacklists. 4.4. Indemnity: The User shall indemnify Inbar Automation Solutions against any and all TCPA or A2P 10DLC fines resulting from the User's misuse of the messaging tools.
5. REAL ESTATE & FINANCIAL DISCLAIMERS
5.1. Fair Housing: The User agrees to use the infrastructure in strict compliance with the Fair Housing Act. 5.2. GCI Projections: All "Forensic Audits" and "GCI Leak" data provided are mathematical projections for strategic planning only. Inbar Automation Solutions does not guarantee specific real estate closings or financial outcomes. 5.3. ADMT Disclosure: For leads in regulated jurisdictions (e.g., California), the User is responsible for providing mandatory "Right to Opt-Out of Automated Decision-Making" notices on their lead capture forms.
6. LIMITATION OF LIABILITY
6.1. Ceiling: To the maximum extent permitted by law, the total liability of Inbar Automation Solutions for any claim arising from the Build or Subscription is limited to the total amount paid by the User during the twelve (12) months preceding the claim. 6.2. Consequential Damages: Inbar Automation Solutions is not liable for "lost GCI," "lost profits," or any indirect damages resulting from system downtime or third-party platform failures (e.g., GoHighLevel, OpenAI).
7. DISPUTE RESOLUTION
7.1. Informal Negotiation: Parties agree to attempt to resolve any dispute via informal negotiation for a period of 30 days. 7.2. Mandatory Arbitration: If unresolved, disputes shall be settled by binding arbitration in the State of [INSERT YOUR STATE]. 7.3. Time Limit: Any legal action must be commenced within one (1) year of the date the "Keys" were handed over or the subscription service was rendered.
8. THIRD-PARTY PLATFORMS
The infrastructure is built upon third-party software (GoHighLevel). Inbar Automation Solutions does not own this software and is not responsible for its server uptime, global API changes, or billing.
